Game begins February 1, 2003 and ends December 31, 2003. 1. To Play Game: The Colortone Interactive Game (the “Game”) begins 2/1/03 and ends 12/31/03 (the “Promotion Period”). Log onto www.colortonegrafx.com and click the Scratch/Win game play icon. Using the Colortone direct mailer, scratch off the prize code circle to reveal your prize code. Enter the prize code number on the website along with all other information requested. Follow the game directions on the website to reveal what prize you have won, subject to verification. Limit one game entry per person per business/company/agency. Duplicate entries will not be valid and only the first entry submitted will be eligible to win. Online entries must be received by 11:59 pm PST on 12/31/03 to be eligible to win. All entries become the property of Sponsor. In the event of a dispute as to who submitted an e-mail entry, the entry will be deemed submitted by the holder of the e-mail account. "Holder of the e-mail account" is defined as the natural person who is assigned to the e-mail address by an Internet Access Provider, Internet Service Provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may prohibit you from participation in the Game if, at their sole discretion, you repeatedly show a disregard for, or attempt to circumvent, these Game Official Rules or act: (a) in a manner they determine to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner. Any attempts by an individual to access the site via a bot script or other brute-force attack will result in that IP address becoming ineligible. 2. Prize: If you did not receive a direct mailer but would like to play the game, call 1-800-411-2727 to receive a prize code, pending eligibility requirements are met in Rule #6. Limit one prize per person. 3. Prizes, Quantity and Odds of Winning: 1ST Prize (250): Travel Mug, ARV: $10.00; 2ND Prize (250): Tape Measure, ARV: $6.50; 3RD Prize (250): Pen, ARV: 7.50; 4TH Prize (1,000): Clock, ARV: $9.50; 5TH Prize (6,500): Magnet, ARV: $1.00 Total approximate retail value of all prizes is $22,000.00. Odds of winning any prize is 1:1. 4. Eligibility: Game open to all marketing department, print and production employees whose name appears on the Colortone direct mail piece. Employees of Colortone, CMC, Inc., and their parent, subsidiaries, affiliated and successor companies, contractors, advertisers, advertising and promotion agencies, participating retailers in this promotion, individuals engaged in the development, production or distribution of materials or in the implementation of the game and the immediate family members of each are ineligible to participate All federal, state and local laws and regulations apply. Game void in New York and Florida. 5. Limitations of Liability: Sponsor is not responsible for or liable for printing and typographical errors in any game-related materials, stolen, lost, not legally obtained, late, defaced, damaged, altered, misdirected, incomplete or illegible entries or for errors in the printing of the offer, administration of the Game, or in the announcement of the prizes, or for any electronic miscommunication or failures, technical hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions which may limit an entrant’s ability to participate in this Game. Further, Sponsor is not responsible for electronic computer network, internet or computer malfunctions, failures, bugs, viruses, intervention or similar difficulties or for any condition caused by events beyond the control of Sponsor that may cause the Game to be impaired, disrupted, or corrupted. Sponsor reserves the right, in its sole discretion, to cancel, terminate or suspend this Game should virus, bugs unauthorized human intervention, systems malfunctions, failures or difficulties or other causes beyond the control of Sponsor and their respective agencies impair, corrupt or affect the administration, security, fairness and proper play or conduct of the Game. Sponsor not responsible for any prize quality or utility defects. If for any reason (including infec-tion by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Game), the electronic portion of the Game is not capable of being conducted as described in these rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Game. 6. General Conditions: By participating, all players agree to be bound by the decisions of the judges and these Official Rules with respect to all Game related matters. Prizes are non-transferable. If any prize is unavailable, Sponsor will substitute a prize of equal or greater value at Sponsor' sole discretion. No cash substitutions or redemptions. Acceptance of any prize constitutes permission for Sponsor to use winners' name, voice, likeness and/or videotape/photograph and any information provided on his/her entry form for publicity purposes in any communication medium, including, but not limited to, television, Internet, radio, or print without additional compensation, review or approval, except where prohibited. By playing Game, all entrants agree to the receipt of future Colortone mailings. If you no longer desire to receive Colortone mailings, call 1-800-411-2727 and request that your name be deleted from list. 7.
